Terms of Service

These Terms of Service (“Terms”) govern your use of fairtravels.ai, an AI-powered travel planning and booking platform operated by Velocity Digital Labs. By creating an account or using our services, you agree to these Terms in full.

1. Service Description

fairtravels.ai is a travel decision engine that combines artificial intelligence with real-time supplier data to help you plan and book travel. Our services include:

• AI-powered travel recommendations and itinerary generation
• Search and comparison of flights, hotels, and travel packages
• Booking facilitation with third-party travel suppliers
• Price lock functionality for holding quoted prices
• Booking management and trip organization tools

We act as an intermediary between you and travel suppliers (airlines, hotels, tour operators). We are not the provider of the travel services themselves. The contract for travel services is between you and the supplier.

2. Eligibility and Account Terms

• You must be at least 18 years old to create an account and make bookings
• You must provide accurate, current, and complete information during registration
• You are responsible for maintaining the security of your account credentials
• You are responsible for all activity that occurs under your account
• You must notify us immediately at support@fairtravels.ai if you suspect unauthorized access to your account
• One person or entity may not maintain more than one account

We reserve the right to suspend or terminate accounts that violate these Terms, provide false information, or engage in fraudulent activity.

3. Bookings and Pricing

• Currency: Prices are displayed in US Dollars (USD) for US-based users and Indian Rupees (INR) for India-based users. The applicable currency is determined by your account region
• Dynamic pricing: Travel prices are provided by suppliers in real time and are subject to change based on availability, demand, and supplier policies. A displayed price is not guaranteed until a booking is confirmed and payment is processed
• Price locks: When you lock a price, we hold that quoted price for up to 15 minutes. If you do not complete payment within the lock window, the price may change. Price locks are provided as a convenience and are subject to supplier availability
• Taxes and fees: All applicable taxes (US sales tax or Indian GST/TCS) and service fees are disclosed before you confirm payment. The total you see at checkout is the total you pay
• Payment processing: Payments are processed securely by Stripe (USD) or Razorpay (INR). By making a payment, you agree to the payment processor's terms of service

4. Cancellations and Refunds

Cancellations and refunds are governed by our Refund Policy. Key points:

• Free cancellation is available within 24 hours of booking for travel dates more than 7 days out
• After the free cancellation window, supplier cancellation policies apply
• Refunds are returned to the original payment method
• Our service fees are non-refundable after the free cancellation window

5. AI Recommendations

Our platform uses artificial intelligence (powered by Anthropic's Claude) to generate travel recommendations, itineraries, and suggestions. You acknowledge that:

• AI recommendations are suggestions based on available data and your stated preferences. They are not guarantees of suitability or accuracy
• You are solely responsible for verifying travel requirements (visas, health advisories, entry restrictions) for your destinations
• Final booking decisions are always yours. We recommend reviewing all details before confirming a booking
• AI-generated content may occasionally contain errors. We continuously work to improve accuracy but cannot guarantee perfection

6. User Responsibilities

When using fairtravels.ai, you agree not to:

• Provide false or misleading information in bookings or account registration
• Use the platform for any unlawful purpose or in violation of any applicable laws
• Attempt to access, scrape, or interfere with our systems, APIs, or infrastructure
• Use automated tools (bots, scrapers) to access the platform without our written permission
• Resell or commercially exploit our services without authorization
• Circumvent or attempt to circumvent pricing, rate limiting, or security measures

7. Intellectual Property

All content on fairtravels.ai — including text, design, logos, AI-generated recommendations, and software — is owned by Velocity Digital Labs or its licensors and is protected by applicable intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from our content without prior written consent.

Content you submit (reviews, feedback) remains yours, but you grant us a non-exclusive, worldwide, royalty-free license to use it in connection with operating and improving the platform.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• fairtravels.ai is provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied
• We are not liable for actions, errors, omissions, or service failures of third-party travel suppliers, including cancellations, overbookings, delays, or quality of accommodations
• We are not responsible for losses arising from circumstances beyond our reasonable control, including natural disasters, pandemics, strikes, or government actions
• Our total liability for any claim arising from or related to our services is limited to the service fees you paid to us (not the total booking amount) in the 12 months preceding the claim
• We are not liable for any indirect, incidental, consequential, or punitive damages

9. Indemnification

You agree to indemnify and hold harmless Velocity Digital Labs, its officers, employees, and affiliates from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the platform, violation of these Terms, or infringement of any third-party rights.

10. Dispute Resolution

We encourage you to contact us first at legal@fairtravels.ai to resolve any disputes informally. If we cannot reach a resolution within 30 days, either party may pursue formal resolution.

For US-based users, disputes will be resolved through binding arbitration under the rules of the American Arbitration Association, except where prohibited by law. Class action waivers apply to the extent permitted by law.

For India-based users, disputes will be resolved through arbitration under the Arbitration and Conciliation Act, 1996, or through the consumer dispute redressal mechanisms available under Indian law.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For India-based users, applicable provisions of Indian law, including the Consumer Protection Act, 2019, and the Information Technology Act, 2000, will also apply.

12. Modifications

We may update these Terms from time to time. Material changes will be communicated via email or a prominent notice on the platform at least 15 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the updated Terms. If you disagree with any changes, you may close your account.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect. The unenforceable provision will be modified to the minimum extent necessary to make it enforceable.
