Terms of Service

1. What FairTravels is

FairTravels publishes AI-assisted destination guides, sample itineraries and a travel blog, and offers an AI travel assistant, Fai, where it appears on the Site. Features that involve searching live availability, holding a quoted price, or paying for travel are offered only where and when they appear on the Site, and may be unavailable, limited or withdrawn at any time. Where such features are not available to you, no part of these Terms should be read as an offer to sell or arrange travel.

Where checkout (defined in section 3) is offered, we arrange flights with airlines as an intermediary and take payment for them as merchant of record, as our Booking Terms describe. The airline provides the flight, and your contract of carriage is with the airline. We do not sell hotels, transfers, activities, packages or travel insurance.

2. Accounts

• You must be at least 18 to create an account or make a booking.
• Give accurate, current and complete information, and keep it up to date.
• Keep your sign-in details secure; you are responsible for activity under your account. Tell support@fairtravels.ai straight away if you think someone else has used it.
• Each person may hold only one account.

We may suspend or close an account that breaks these Terms, gives false information or is used for fraud.

3. Bookings

In these Terms, “checkout” means the booking steps on the Site or in Fai (including the traveller details card in the chat) and the payment pages they link you to, including our payment processor's hosted pages.

This section applies only to bookings made through checkout. They are also governed by our Booking Terms and Refund Policy, which set out prices, taxes and fees, payment, how long we hold a quoted price, changes, cancellations, refunds and who does what. We do not sell travel to residents of California, Florida, Hawaii or Washington.

4. Fai and our content

• Fai is an AI system, not a person. Its answers are generated automatically from the information available to it and what you tell it. They are suggestions, not advice, and can be wrong or out of date.
• Our guides and articles are written with the help of AI tools. Prices, opening hours, fares, visa and entry rules and safety conditions are general guidance written at publication and may be out of date.
• Confirm visa, passport, health and entry requirements with the relevant government or embassy, and prices, schedules and policies with the airline or provider, before you make plans or spend money.
• Sample itineraries are examples, not tailored to you and not reservations.
• Your travel decisions are yours. Fai does not book or pay for anything unless you confirm it through checkout.

5. Acceptable use

Follow our Acceptable Use Policy. In short: don't use the Site unlawfully, give false information, scrape or attack the Site, try to make Fai produce harmful or unlawful content, or enter anyone else's information unless you're allowed to.

6. Intellectual property

The Site and its content belong to Velocity Digital Labs LLC or its licensors. You may read and share links for personal, non-commercial use; you may not copy, republish or adapt our content without written permission. Photographs are used under their licences. If you send feedback, you keep ownership and give us a non-exclusive, worldwide, royalty-free licence to use it to run and improve the Site.

7. Other companies' services

Airlines provide flights under their own conditions of carriage, which apply to any flight you book through checkout. Our booking partner Duffel and our payment processors (Stripe, and Razorpay where we offer payment in INR) work for us, and we are the merchant of record for payments made through checkout. Map providers and linked websites provide their services under their own terms. We are not responsible for websites we don't operate.

8. Disclaimer

Except as our Booking Terms and Refund Policy say, the Site and its content are provided as is and as available, without warranties, to the extent the law allows.

9. Limitation of liability

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive loss, or for what airlines do or fail to do (we will help you contact them), and our total liability for any claim about our services is limited to the service fees you paid us in the 12 months before the claim.

This limit does not apply to refunds due to you under our Booking Terms or Refund Policy, or to money you paid us for travel that was not provided. Nothing in these Terms excludes or limits liability that cannot be excluded or limited by law. If you are a consumer, this section does not affect your statutory rights.

10. Indemnity

If you break these Terms or misuse the Site and someone claims against us because of it, you agree to cover our reasonable losses and costs from that claim; for EU and UK consumers, only as far as the law allows.

11. Disputes

Contact legal@fairtravels.aifirst; if we can't resolve a dispute within 30 days, either of us may start formal proceedings under this section.

United States: if you live in the US, disputes go to binding individual arbitration by the American Arbitration Association under its Consumer Arbitration Rules; either of us may instead bring an individual small-claims case; class and representative actions are waived to the extent the law allows; you may opt out by emailing legal@fairtravels.ai within 30 days of the day these Terms first apply to you (for a booking, the day you book; otherwise the day this version takes effect or, if later, the day you first use the Site).

EU and UK: the arbitration and class-action paragraph does not apply to consumers living there.

India: disputes may go to arbitration under the Arbitration and Conciliation Act, 1996, or to the consumer dispute redressal mechanisms under Indian law.

12. Governing law and courts

Delaware law governs these Terms, without regard to conflict-of-law rules. Subject to section 11, the state and federal courts located in New Castle County, Delaware, have exclusive jurisdiction. EU and UK consumers also keep the protection of the mandatory laws of their country of residence and may sue in their local courts. For people in India, applicable Indian law, including the Consumer Protection Act, 2019 and the Information Technology Act, 2000, also applies.

13. Changes to these Terms

Each version of these Terms shows the date it was published, and previous versions stay available from this page. If we make a material change, we will give at least 15 days' notice, by email to account holders or by a prominent notice on the Site, before the new version takes effect; other changes may take effect when they are published. While a change is pending, this page says when the new version takes effect, and the previous version applies until then. If you book through checkout, you accept the version shown there, and it applies to that booking. A new version never applies to a booking made before it was published. If you don't agree to a new version, stop using the Site and delete your account in Profile before it takes effect.

14. General

If any part can't be enforced, the rest stays in effect. A delay in enforcing a term is not a waiver. You may not transfer your rights without our consent.
